According to data released by Israel, a minimum of 98 Palestinian individuals have lost their lives while in custody starting from October 2023. A human rights group operating from Israel has stated that the actual figure is probably substantially greater, because of hundreds of unaccounted for individuals originating in Gaza.

Study Results

A new investigation recorded casualties resulting from brutality, failure to provide medical care, and malnutrition. Researchers employed transparency petitions, forensic reports, and discussions with attorneys, human rights defenders, next of kin, and witnesses.

Official sources released complete information only for the initial 240 days of the conflict. During this time, reported numbers indicate an unprecedented casualty rate among detained Palestinians, amounting to one death every four days.

Latest Data

The military most recently revised information on detention fatalities for May 2024, and correctional authorities in September 2024. Investigators discovered a further 35 casualties in custody subsequent to these timeframes and validated them with Israeli authorities.

Although the total number of fatalities charted being significantly higher than earlier projections, it likely omits the complete extent of Palestinian casualties, per the director of the prisoners and detainees department.

“Even though we are presenting proof for a greater figure of fatalities than earlier indicated, this is not a full picture,” he stated. “We are sure that there are still individuals who died in detention that we have not identified.”

Civilian Deaths

Restricted government records suggests that the largest portion of Palestinian prisoners from Gaza who perished in prison were ordinary citizens, based on a simultaneous inquiry.

In May of the current year, a defense forces registry following all fighters in Gaza, a registry of more than 47,000 listed people, recorded merely 21 deaths in confinement. At that time, 65 Palestinians from Gaza had lost their lives in jail.

Custodial Environment

Assault, torture, and further cruelty of Palestinian individuals has been normalised across Israel’s prison network throughout two years of conflict. Senior officials have publicly acknowledged inadequate food and an underground jail holding detainees who never see daylight.

Present and past detainees and insiders from the Israeli military have uniformly asserted systemic violations of human rights protocols.

Institutionalized Cruelty

The institutionalised cruelty came with a troubling surge in deaths documented across no fewer than 12 civilian and military facilities in Israel. During the previous decade before the hostilities, there were on average a couple fatalities a year.

“This does not represent only a single occurrence occasionally. It is institutional and it is expected to endure,” a representative commented, in part since there is a climate of virtual exemption from consequences for harming and abusing Palestinian individuals.

Just one case of beating detainees has reached litigation, with the soldier handed a punishment to half a year. An attempt to prosecute additional individuals over a brutal attack involving sexual violence resulted in political demonstrations and the apprehension of Israel’s top military lawyer, with the alleged perpetrators now demanding that indictments against them are dropped.

Absence of Consequences

“Regardless of this significant total of deaths, throughout the conflict not a single person has been arrested,” the representative said. “There exist no indictments over any death.

“As long as these practices continue to be enforced, all Palestinian detainees in detention is at peril, including the healthy ones, even the youth who have no underlying conditions.”

Prominent Examples

Some deaths in confinement have been publicly known, such as a 50-year-old healthcare leader who lost his life in confinement after four months in detention.

A detainee detained alongside the individual testified that he was led to the yard by guards just prior to his passing, clearly wounded and unclothed from the hips downward. His body has not been returned to Gaza.

Further inmates who perished in confinement by Israeli authorities stay unnamed. Correctional authorities and military supplied researchers with the number of casualties in custody, and minimal further data including the site where they lost their lives, but without the inmates’ personal details.

Identification Challenges

Regarding 21 occurrences, mainly individuals from Gaza, investigators were unable to connect the limited information given by government bodies to a fatality documented by advocacy bodies, via accounts from freed prisoners or coverage in the news outlets.

The prisoners’ relatives may not know about their loved ones’ deaths also, as Israel has impeded efforts to monitor Palestinian individuals it is confining. For seven months at the beginning of the hostilities, the Israeli military refused to provide basic information about the condition of numerous of people held in Gaza, practically implementing a policy of forced disappearance, per the human rights group.
